Hello All:
It is great that the dates have become current and many of our friends here at IV can apply for 485. Congratualtions!!! to all that can apply.
I am in a dilemma and don�t know what to do:
My LC has been approved PR 02/10/05
My I-140 is pending.
I know I can file for 485 but my wife is on F1 � OPT and is working she has applied for a H1 and will get it because of Master�s quota but will not be effective till October, 2007. Can I file 485 now even though she is on F1?
I have two choices, either wait till October 2007 or cancel the H1 go to Mexico and get a H4 stamp for my wife and apply for 485. Please advise what I should do. Thanks!!!

Thanks for posting 2007 cloture vote. So 53 senators voted in favor of 2007 CIR cloture. If even half of the following 15 Democratic Senators (who voted against the cloture vote) would have voted in favor of 2007 CIR, the bill would have passed the cloture vote, right?

Look, I am merely saying that it is kind of an urban legend that Democrats support immigrants. But the fact of the matter is, that is entire false belief. And beware when Democrats take over the White House and the Congress in 2008. Legal skilled community is in for a very tough times ahead.
Although, I must add, 2007 CIR was a death-trap for skilled legal community. It would have made life of skilled immigrants very difficult. But non of these 15 Democratic Senators voted against the bill because of this reason. Most of them were pandering to their base to make sure that they are re-elected. Because going back to 2007 bulletin is lot of work for them. Looking at PD of each application and seperating it from the lot. If they just made it U, its easy...send everything back.
They have to do those work anyway. Because all the applications are not I-485 and also some ppl filed I-140 along with I-485. So, they do have to repackage those applications. Let us see,how events develops for couple of more days?.

Dear Folks, I have a question:
For example, if someone's Advance Parole document validity is terminating on (say for ex), July 16, 2009, then, should the person apply for renewing his/her application prior to July 16, 2009? In other words, should a person's application to renew his/her AP document be made prior to the termination of the current one, OR, could this application for renewal be made after the current AP document's validity expires (in this case after July 16, 2009)? Thanks a lot, friends.

I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

I worked for 'Employer #1' from Jan-2000 to Jan-2005
Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2

Your post absolutely doesnt make sense. You are asking us here "485 RFE and USCIS asking paystubs for employer you never worked"
This does not seem to be a 485 RFE but a H1 RFE. Put some sense into the post before posting here and confusing people. How can yours be a 485 RFE when employer X never sponsored your GC and when USCIS is asking paystubs from Employer X for H1 transfer and when your GC is still running with Employer 2. Senseless post.

Look, i sympathize with you but you SHOULD HAVE poured in some money to start a parallel PERM application ..... PERM started from APR 2005 - you got almost 2 years +
My case is also like you but my Labor was 2 years old and applied just
before PERM and it went straightway to Phily Backlog center ... I thought
of applying for a Parallel PERM but mine was a RIR ( quicker) and Phily was saying that they would clear all Backog by SEP 2007 ( another 2 months)

It clearly mentions that the immediate application of I-140 and I-485 applies to f-4 visa holders only that too if they find a job in their field within 1 yr of graduating. and on payin $1000
it remains to be seen which category is elgibile for f-4 (only phds or more). it is possible that some current students on f-1 will be eligible for conversion to f-4.
for rest of f-1 students it simply allows for 2 yr OPT instead of curretn 1 yr.
it also implies that the labor cert exemption does not apply to already graduated MS or PhD STEM degree holders with or without 3 yrs exp.

This is regarding the recent ( rather today's) enquiry with House Committee of Judiciary on SKIL bill, HR-5744. The bill is referred to Committee on Home land security.
They are on recess till Monday. The first step is to Mark up this bill on there calendar. That is very important. I do not know how we can influence them to do so.
We need to work specially with small group of House of rep under House of Committee on Homeland security. (www.HSC.house.gov).
I believe that chairman of this committee is the most powerful person; it is usually one man show.
We need to draft a letter specifying the chairman.
It is much better to convey one person that 500 representative.
I will be drafting a personal letter and sending him by email, by post and fax.
Based on petition posted in this website , I see almost 1000 people signed. If 1000 people do the same thing to Chairman Rep.Peter King, there is a good chance that he will atleast look at the matter.

And the worst thing is they approve it from the date tey approve it to 1 year after..My EAD which was expiring on 2th Sep'2008 was approved until Jun 20th 2009. Basically I got a 9 months extension...What a plan...

I know everything, i have been following these forums from past 3 yrs, but i responded to the post by ksircar, he said "I think some SELFISH people with recent PDs are scared as people with older PDs may take the quota" which was inappropriate, cursing core members or people who are eligible to file 485 doesn't help right? that's all i want to say.
Here I want to make clear, FIFO for taking labor applications and sending ad instructions not for approving. I know depending on compilcation of cases(I think), some cases with PD 2005 get approved fast and cases with PD 2003 are taking longer. I dont know why all these mess in DOL, for taking the labor applications and sending ad instructions.

I am at the final stage,
my attorny just sent back my DS-230, and just got wait for the dates to br current.
so i can get the last bit at the embassy sorted, and yes i am doing CP, its my only option. and yes i do have all the rellevant experice and qualifications, i never would have got my i140 other wise.
it carnt stay at AUG 02 for ever. it will move, just got to see what happens.
