IV Core,
What is IV's position on ammendents for people who have filed PERM only and have not filed I-140 yet.
There shall be an ammendement which allows these people to keep using old system(EB) to get their green card.
It is totally un-fair to null and void their application and get them into new point based systems and force them to face long delays.
Please let us know.

I wasn't planning on porting my PD until I read this nonsense "Injunction" threat. I will now port my PD; GCTest - go and file your injunction. If you don't have enough balls to do that I can lend you one.
That memo/document you pointed out is an interpretation. We have already said that USCIS's interpretation is incorrect. We intend to correct this interpretation with this lawsuit.
Infact, it would be wrong to call this a lawsuit.
We are aiming for an injunction (or a stay order) in step 1 of the lawsuit that would prevent USCIS from working on any interfiling/PD porting requests.
If the injunction is with retroactive effect, all the EBs (not just EB3) who have ported their PDs will have their cases frozen. USCIS would not be able to work on them.
The remainder of the lawsuit can take its sweet time... the injunction should serve the primary cause.

I had been going though the same phase. More from the last 6 months, from when my dates are current and nothing is happening. Its been a long wait, more than 7 years and counting.
Only time I feel less pain is when I compare the pain, to a person or post from my land who are waiting from 2001 and still having hope. When I go to India and see some of my friends who are now project managers, I get to think whether it was worth the waiting or am I living in a black hole.
From last 4 - 5 years, even the salaries are at par. I could have enjoyed life more than here and be with my parents and friends. But, I don't have to blame anyone as it is me who choose to live in pain and now when I am used to it and had fear of loosing it.
But, then I still believe in GOD and know that he would make me sail through it one day.
No pun here but Cheers. Have faith in almighty and one day you will get answers to all your questions.

My application was finally approved yesterday after almost 7 years in queue. Here is the sequence of events right before the approval.
RFE email on 02/13/09
2nd Biometrics Notice received on 02/17/09
Lawyer receives RFE for EVL, EAD cards and Marriage Certificate on 02/24/09
Completed Code 3 Biometrics on 02/26/09
Soft LUD immediately after Biometrics on 02/26/09
USCIS receives RFE reply on 02/27/09, Hard LUD and email on the same day
Another soft LUD on 03/02/09
CPO email on 03/10/09
Welcome email on 03/10/09

So, I guess, all we can do is eat the kela that has once again been given to us...
Those comments were made by the President before the Senate Democrats press event. In fact one reporter asked Sen. Reid about the President's comments. It is not possible the Senate democrats do immigration press event on the Hill without the concurrence of the President.
We think that the President is trying to make his sincere push for the reform which requires a bi-partisan support. He did not say that he is taking immigration off the agenda. So this article is misinterpreting the comments of the President.

There was a change in LUD for both me and my wife on 3/4/09. Then on my wife's, there were LUD ON 3/5 & now 3/6/09 also. When I open the Case Number, it shows the usual information "Current Status: Case received and pending". Any idea what this could mean. Thanks.

i thought it meant that you had to wait 4 months after your priority date is current to have any expectation of adjudication... no?

Hi All,
How much time total process takes I think case by case. In my case it took around a year( from request to sponsor Eb2 to I-140 approval (premium processing). I had no perm auditing. I had no RFE on I-140. I filed my EB2 with the same employer.

Just got my 140 approved...no confirmation from the employer yet but received email from CRIS saying they mailed the approval on April 15. Looks like the published processing times are being adhered to.

The way dates are moved doesn't seem to have any fact based intelligent logic.
Pardon my ignorance, but where does the data on the last 2 columns - the one for I-485s - come from? And does that includes Family+EB?

I understand your pain ( I am in the same boat ). EB3-I PD:June 2003. All we can do is keep the struggle going.
I plan to save the money to convert it to EB2 rather than spend here.

Durbin also got one "favorable" amm. for us - another $1500 for each recaptured visa number. I believe after all expenses, and all time spended on the immigration and exams, majority of us could deal with that extra cost, or "bonus" if you like::))) So I hope that Durbin's amm. will calm down anti-immigrant forses and Cornin'n one will pass!
