Hi Folks,
Anyone have any experience with or knowledge about filing a 7th year H1-B extension per AC21 106(a) when labor certification was filed under PERM more than 365 days ago and the I-140 has NOT been filed / approved yet? There is a 12/27/2005 USCIS memo says "Guidance on this subject will be provided in a seperate memorandum", but then there is no seperate memorandum (that I could find).
My lawyers are telling me I can't file for a 7th year extension because I filed for LC under PERM, but after researching the matter, I am pretty sure they are mistaken. First, the language of AC21 states "the filing of a labor certification application on the alien�s behalf"... no distinction between ETA 750 (Traditional LC) or ETA 9089 (PERM). Furthermore, I've read various accounts on the web that state USCIS is in fact approving 7th year AC21 106(a) extensions based on PERM, but I haven't had anyone confirm that they actually did this or know first hand of someone who did.
Any help would be greatly appreciated !

Im in the process of filing a new GC in EB2 category which eventually I will port to my older EB3 application. I wanted to find out if we need to do our Medical exam again during the I-485 stage?

My I-485 has been pending for more than 6 months now. I have an EAD but I got an RFE on my AP. I don't know what its about as I have not received the RFE yet.
I am thinking of changing my job. In my new job I don't want to use my EAD since my AP status is still hanging. Can I keep working on H1-B visa as I still have 3.5 years left on my H1? If I travel outside the country, can I re-enter with a valid H-1B visa? Can this cause an abandonment of AOS if I enter on H-1B while my AOS is pending? Please let me know. Thank you.

I had filed my i-485 along wid my whole famliy on 2nd july . My checks got cashed yesterday for all of us. But when i seee online its shows case pending for all of us expect my younger son ..w ehave reciept but we cant locate his reciept number online.Its showing number doesnot exist . So wat can be the reason behind it. I have reciept numbers for his i-485 and i765 juss can see his status online..

I have filed for my I-485 application (based on a approved I-140) in July 2007. At that time I also filed for another I-140 based on a substitute labor that I got which had a earlier priority date.
Now that new I-140 that I filed with substitute labor is approved. I am looking at possibility how I can use this new I-140.
I heard there is something called changing underlying I-140 application. Can someone explain this and tell me how I can use it in my case please.

Hi guys,
MY H1b extn is due in November.But as my marriage will be in May or June i need to go to india.My employer says he can file h1 Extn only before 6 months of expiry.
My question is cant he file for H1B extn before 6 months.
Can I file for extn and leave to india while H1 extn is under process.
If i file under premium are there any disadvantages for it and how long it will take for it to approve.
The only reason iam planning to file h1b in 2-3 months from now is i dont have last 2months of paystubs as i was on vacation and other reason is my current project may be done in may or june.
So please advise me what is the best way to deal with the situation.

I think you need to reapply for H1 again (unless you are transferring your visa category to H4).

I am on H1-B and my 6 years of H1B is going to complete on Sep so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I do have the copy of my I-140
