Dear Members,
As we enter the final 15 days of our advocacy days preparation (http://immigrationvoice.org/forum/showthread.php?goto=newpost&t=1437978) we would like to thank our members that have indicated that they would be coming to DC on June 7 and 8. We also want to thank all State chapters, volunteers and action item leaders that have been helping out with the effort behind the scenes. The massive planning, coordination and implementation cannot happen without the support of each and every member. Help has ranged from phone call campaigns, media campaigns, lawmaker meetings, document preparation, state chapter activities, accommodation initiatives, reaching out to various employers and like minded organizations etc.
We still have a long way to go in our coordination and implementation. IV membership is working hard to make this event a success. The advocacy day work is being implemented at this time and lawmaker office appointments are being sought. Everyone that has indicated their presence for this event will be contacted personally. We are planning an impressive congressional reception event on June 8, in DC and expect several lawmakers, staffers and leaders of other like minded organizations attending the reception. It will be a great opportunity for IV members to meet these important representatives. There is also going to be a notable Press event on June 8 that we are planning. There are several initiatives being taken that we will be announcing in the days leading up to these events. The event is in itself a huge task that requires planning from getting space for various parts of this event, space for gathering of all IV members (situation room) to transporting all advocacy day material, providing training sessions for members, getting appointments from lawmaker offices, inviting reporters, press release to details like photocopying documents for each meeting, folders and digital advocacy media with IV branding and soft copy of all IV documents as a leave behind in every lawmaker office.

These emails, letters and communications will help us with more effective and targeted advocacy to help get much needed attention for our issues. All this will need investment from IV and we can do it only if our members support us in this huge task by contributing funds as well as time. IV effort needs 50 thousand dollars in the next 15 days to make sure we can meet our immediate needs and also make a big impact via this advocacy day events. We can plan more ideas like full page ads in national newspapers if we can have sufficient resources. This event will most certainly bring our issues to the national center stage and help us get much needed immigration relief in the months ahead.
We are a small grassroots organization with a strong resolve and when we all pool in our energies, intelligence and resources; we can all collectively create wonders. We do not want our limited funds to stop us from going all out. Despite our fulltime jobs, IV core is committed to work harder and we are happy to have the asset of a large IV community to support us in this mammoth task.
This post is to urge everyone to come forward and help yourself in this short term funding drive. If you have not contributed till now, please consider contributing. If you cannot make it to DC due to personal or professional reasons then do show your admiration for our effort. If you have recently received your green cards, then please consider contributing as a way of celebrating and endorsing our effort. This is like telling passengers to move to the other side of the boat when it starts sinking one side. The outcome is only making the boat sink faster. Remember, the huge backlogs are not completely due to unavailable visa numbers.
Unless there is a real need, moving from EB3 to EB2 dont make much sense.
Do not agree with this. This is not a fair analogy.
Nobody is saying IV should stop efforts for administrative and legislative fixes.
If someone has an option to switch to EB2, he/she should definitely try it.

The U.S. Department of Labor today announced that it has begun auditing all permanent labor certification applications filed by attorneys at Fragomen, Del Rey, Bernsen & Loewy LLP. The department has information indicating that in at least some cases the firm improperly instructed clients who filed permanent labor certification applications to contact their attorney before hiring apparently qualified U.S. workers. The audits will determine which, if any, applications should be denied or placed into department-supervised recruitment because of improper attorney involvement in the consideration of U.S. worker applicants.

bigboy.. We need about 20 volunteers per state to pledge 200 letters each. It is achievable. But 20 volunteers is far from reality. That is our challenge.
Friends Please dont jump on me as i make these comments. I am doing my best to convince ppl as i see across to Join IV and contribute to our efforts. But i also think that every state chapter should allocate some members who only concentrate on grass root efforts but nothing else to track how many memberships and etc and those should co-ordinate with every state to see how much they can target and how much did they reach. I know this might have been thought by some others but just what i am thinking ?

I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

I worked for 'Employer #1' from Jan-2000 to Jan-2005
Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2

1. You are continuously employed WITHOUT any gap, meaning working 40 hrs/ week and clean history of pay stubs, W2s etc
2. You have been working for only one employer at any given point of time, as a full time employee
IF What i said above is true, then RFE makes no sense. because based on the H1B rules and regulations, one can have multiple H1Bs BUT can only work for ONE employer as full time, meaning 40hrs/week.
It is also completely legal that one can work up to 20hrs/week for second employer by paying proper taxes . but in your case i believe that you have worked for only one employer and i think you can show the evidence.
Please contact your attorney and draft a response carefully

my I-485 was nicely pending @ TSC, and the company just sent H1 papers off to VSC for processing, so I can come back on H1. I am currently sitting in London (working for my GC employer from their UK office), when I got the Card Production E-mail. My previous H1 approval expired in March.
My EAD will expire next month, as well as AP. So, here is the rub, they will not let me come back to US on AP since system shows GC approved, H1 will be rejected since GC is approved.
needless to say PD is not current. I kind of remember having an approved RIR Labor with PD June 2004, but I dont remember having sent for I-140...No idea what to do and how to check that.
Dont trust company's lawyer, and I sent all I-485 papers by myself back in July 2007. I have an attorney that I bug from time to time but he is on vacation now...
So... am I completely screwed...?
My employer transfered me from US to UK couple of months ago, now they are transfering me back. I did go for H1 stamping in Dec here in London and IO said something like, my GC is taking too long, he will check why I dont already have it..
Just venting here, no clue whom to talk to next....
Any suggestions are welcome...

If many EB3 people start porting to EB2 then EB2 queue will grow. But if we think how many already jumped the line using so many ways...this is not a bad option at all. As long as we qualify for EB2 and employer is ready its the best thing to do for people waiting with 2002-2004 PD.

I think it is important to maintain diversity in the overall immigration. However the immigration law has never resulted in achieving diversity. In the period 1900-1910, immigrants came from Italy (22%), Austria (20%) and Russia (18%). In the 1950-1960 period Germany provided 20% of immigrants. In the 1991-2000 period Mexico provided almost 22% of immigrants. In the FY 2005, Mexico provided around 161,000 immigrants (around 17%) of immigrants. It is easy to fix a quota for those immigration categories where visa numbers are limited such as for employment. However spouses and minor children of naturalized citizens have no waiting period. So it will be very hard to control the immigration percentages based on country of origin unless there is a quota for US citizen spouses, and children of US citizens wantin to immigrate!
The problem here is that we don't have a country quota for foreign students and H1Bs. Thus when these people try to become permanent residents then the quota's are applied and that is the core problem. My take is that country quota should not be applied for employment based immigration. Employers should not be forced in to an affirmative action plan but rather hire the right person for the job.

Sorry - I can't currently access the report you quote your oringinal figures from at the beginning of your quote. Are these numbers of total immigration, or immigration in the highly skilled category?
