One thing I noticed in this thread is the lack of differentiation between attorney's who were hired directly by applicants as opposed to ones hired by the company one work's for.
I am sure there is wide gap in how law firms operate when interacting with either of the entities.
I would be interested in getting some references from people who have hired their own attorneys and their experience with that.
Even I am looking to hire an attorney to transfer my wife's case and then join the waiting game..

A friend of mine transferred his H1b from company A to company B. He applied for the H1b transfer and then started working on company B. His H1b from company A expired while his petition was pending with USCIS. He received an RFE after 3 months. Company B responded to RFE but received one more RFE for the previously responded RFE. Now my friend fears that his H1b transfer petition may be denied. Would it be possible for my friend to return to company A and apply for H1b under premium processing even though his H1b with this company expired couple of months back? He has been working all this while on the basis that his petition is still pending with USCIS. Any suggestions or advise would be much appreciated.
Legally you can start working for company B once you get the receipt.
think there is no limitation on number of H1's filed for one. so you can go back to company A for the H1 or go to a new company C for that matter.

Could you please translate this into layman's English? What you appear to be saying is that speed (CIS efficiency) is more important than number (quotas), but your expample confirms that cases are stuck because of number unavailability (quotas), not because of CIS inefficiency. You got your own green card in three months, did not you? That tells me that CIS darn well capable of processing applications in a timely manner.
Like I said, its a combination of the 2 main things, the efficiency of processing and the quota limits. Changing either 1 without the other other probably won't get us far.

I know this is probably asking for trouble but no movement can be credible without listening to the dissenting voices. So here is my gripe ... You cannot open a single thread or forum without being asked for contributions these days. People are told that if they dont contribute, they are not "supporting the cause".
But the stark reality is this... If you look at the IV website to see what action/progress has been made in "the cause"....there is some vague statement about Patton Boggs and how we have this lobbyist who is educating congressmen...Who exactly? How? When? Oh those details cannot be given.
There is a link about IV in the news...the last time IV was in the news was in Sept 2007 ...19 MONTHS AGO...
Then there is a link about IV and FBI namechecks...The last update is some thread in Feb 08 and this brilliant statement from 2007 ..."IV has met officials from agencies and has raised this issue in the recent past. How can you justify this? Actually, you dont have to....There are many like me who will answer questions of panicked people about how to navigate the complex immigration system but until IV can provide some concrete proof of what specifically it is doing, how exactly it is spending the money and what roadmap of progress it hopes to achieve and whether it is on its way to achieving it....the money wells will continue to be dry.
And this new caste system of the DONOR forum which basically says screw you to everyone who has spent time, money or effort on IV and completely goes against the "Change for fairness and Justice" mumbo jumbo is a step in the right direction, IV needs to give way to an actual movement that actually does something and this DONOR forum concept will certainly go a long way in the marginalization of this site and community.

I dropped the letters in my garage yesterday and thought I had picked them all up. But there were few that were hiding under the car. And this morning they came under the wheels :(

the question: 3 on page 3 "If the travel document will be delivered to an overseas office, where should the notice to pick up the document be sent:"
in part 7 of the application --> can it be left empty???
since we r expecting to AP approval to arrive by mail to our mailing address, can we leave this question 3 on page3/part 7 EMPTY?

I saw lot of posts above saying good things about them however my experience with them has been bad. I am assumng this is Fragomen, Del Rey, Bernsen & Loewy, LLP we are talking about.
There have been a couple things in the past but the most frustrating one was that even though I sent them all my papers etc. by Jun 20th (so that they can file it on July 2nd) they did not file my case until Aug 08. They are my corporate lawyers so I don't have any choice. Also, they asked us not to contact regarding status during this period as they were really busy. While not responding to status queries was understandable, they still took more than a month to file cases. I confirmed with a lot of my colleagues who were in the same boat and were equally frustrated with noncommunication and taking so long to file the cases. They also were not maintaining any apparent first come first serve queue because there were several folks who got their filings done much sooner than others who had sent complete paperworks way before them.
Based on my experience, I wouldn't recommend them.

Why do they need money to respond to RTI request. IF they don't have a program, its their job to comeup with one. They shouldnot/cannot go asking for money.

My understanding is advanced degrees can be from any country but the 3 years work experience requirement refers to work experience in USA.

I am very glad that you brought this point. Nothing would give me greater pleasure than suing the DOL. We may not sue DOL on their inability to clear the backlogs, but we can definitely sue them in their utter and deliberate disregard to FIFO procedures (mind that some people with priority dates in 2004, 2005 have already got their labor certifications, but some with priority dates in 2001, 2002 are still stuck). When I read on the DOL web site that they have tried to maintain FIFO, it makes me feel like puking.
Some folks have pointed that the lawsuit is not worth, as it has little chance of winning. To me personally, more than winning or loosing, it is a matter of bringing injustice to the light, as Gandhi has said something in this line: First step against injustice is to make it visible. This law suit will bring public scrutiny to the misdeeds of the DOL.
Even if all the backlogs get cleared by September 2007, severe damage has been already dealt to our lives. Though I am close to getting my labor clearance (I filed RRI few weeks back), I am strongly in favor of continuing with the law suit even after getting the labor clearance.
Let�s get IV�s attention and support in this area. Let�s talk to AILA. Let�s write letters to senators and house representatives (congresswoman Lofgren may be good person to start with). Let�s write to media personnel. Let�s do whatever needs to be done to expose this insult and injury to the immigrants who waited in the line for years and followed rules of the game.
I would strongly suggest talking personally to IV leaders about this. These are folks who by now really have a feel about how things are handled out there. They will suggest the best way to tackle this issue and am sure with their mature guidance, this is a very simple techinical issue that can be resolved. You are literally just saying "SIR, I WAS HERE BEFORE. I KNOW YOU ARE BUSY AND POSSIBLY FAILED TO NOTICE ME, BUT HERE I AM, AND I HAVE BEEN WAITING FOR LONG TO GET YOUR ATTENTION". honestly I dont think even USCIS wants to hurt you purposely, its just that the traffic of new PERM thing has overcrowded their desk and mind so they have shelved your applications unknowingly. PLEASE SHOUT OUT----THROUGH IV ONLY. let them realize that we have a strong organization and ONLY ONE STRONG ORGANIZATION.

If bill is passed Senate in 2007 it will pass current form for H1b. There is possiblity for failing of the bill is 75% now. Also even if Cantwell amendment is passed that will give relief only to high tech companies not for Hospitals or Health care. There is no other amendment other than Cantwell for H1b or GC relief in Senate

But I am almost certain that Most persons who file I485 within next 6 months will get GC within 1 to 5 years whether CIR is passed or not.
