    Are you sure your employer didn't sneak in a labor sub without your knowledge??

    If not, you got a lucky break, just cherish it? Once in a while USCIS gives us good surprises too:D Few of the folks don't have the guts to share such a lucky break on the forum, thanks for letting us know. EB2 visa's are available and hence the approval won't be a surprise except that u'r PD's aren't current. It would've been a huge surprise if this happened to EB3-I. May be the adjudicator mistakenly saw U as a ROW applicant. We all wish this adjudicator be assigned with lots of cases:D

    I have been speaking to colleagues and friends. Not many were aware of the rally others didn't think it would make an impact.After I showed them the website and BBC news article they were listening. I was hesitant to come there now that i was there i will attend a 2nd, 3rd and everyone. People in different parts of the country should lobby and bring 20-30 people and then you'll see numbers. Before the rally run some ads on popular channels and newspapers and motivate them.

    PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.

    Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.

    PD Nov 2002 and beyond : Have to actively consider switching to EB2. Myself being in this range, I am doing the leg work and waiting to hear on what happens to the recapture bill. If it does not happen then these PD's should switch if they can and qualify.

    Instead of being jealous towards EB2 bonanza , I think EB3 applicants should make use of this Eb3->EB2 conversion option and participate in the bonanza.

    Yes, it costs additional 9K . Consider that the price of the ill advised decision to go in for Eb3 to begin with.

    An opportunity to get past this GC mess and start realizing your dreams on both personal and professional front.

    Anyways, Any guesses on what the PD will be in Oct VB? My guess is they'll not progress much and will try to stick to the June Bulletine timeframe..
    Oh trust me WE KNOW THAT. We're just testing the waters now with the USCIS agents :p

    I have many positive experiences with Fragomen.

    My RIR case was first filed in 2001 by a different lawyer and he screwed it up. It got rejected by DOL and bumped back to non-RIR. When the BEC was about to take the case for processing, my company hired Fragomen for the processing. Fragomen reviewed my case, worked with me, prepared and filed a new Labor petition in 24 hours as I was reaching my 6th year limit.

    When PERM was introduced, they worked with me to convert my traditional labor filing to PERM.

    During the July VISA bulletin fiasco, they kept communicating well and worked overtime (I used to get emails around midnight sometimes) and filed my case. They even followed up and made sure that I was going to attend my finger printing appt when they got the courtesy copy.

    They do well with email replies. I have never called them and hence, not sure about responding to calls. But I never had a requirement to call them as they normally reply to emails within 1 working day.

    Since Fragomen is so big, they might have a small percentage of attorneys / para legals who are not customer focussed. I have dealt with 3 different attorneys / para legals withing Fragomen, and I have high regards for them.

    Hi
    I am currently in US. I Have withCompany A for almost 2 years, I plan to do H1 transfer to Company B, Here I understand, I need to give last two months pay statements (ie., pay statement with Company A).
    I can join in Company B at any time once H1 Transfer done.

    At the same time, My Company A is planning to do H1 transfer to its sister concern Company C.


    Scenario A)
    Assume I transferred my H1b to Company B my own (using Company A's two month pay statement), then after 10 days
    my present Company A transferred my H1b to Company C,
    Ie., I gets pay statements from Company C.

    Queries #1)
    Can I join with Company B ?
    Should I need to produce Company C's pay statement if I decided to join with Company B ?
    Should I need to do another H1 Transfer to Company B ?
    becz, I did H1 transfer to Company B before I join to Company C.


    Scenario B).
    Assume
    I didnot transfer my H1b to company B,
    My present Company A transferred my H1b to Company C,

    Queries #1)
    Can I do H1 Transfer after I join in Company C (with in 1 or 2 months) ?

    Could you please advise. Thank you.

    Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.
