Hi folks,
I used to work in company A where my I-140 got approved but I was laid off. Now I am with company B in a higher position and pay but B has delayed filing my PERM. As the economy is bad so I am looking to go back to A and file 485 when PD is current. I need to give a copy of H1 for transfer from B to A. Will i be needing the original H1 copy from B at any time as B gave me a copy not the original (weird).

Washington, Jun 30 - As the United States works to maintain its economic competitive edge, U.S. Representative John Shadegg (R-AZ) introduced legislation yesterday to help retain the innovative minds of foreign-born nationals here in the United States.
“We have benefited greatly from the many foreign-born scientists, engineers, health care professionals, and teachers that help keep America moving forward,” said Shadegg, a member of the House Energy and Commerce Committee. “To our detriment, current policy mandates that we educate and train these brilliant individuals and then send them away to other countries to compete against us.”
H.R. 5744, The Securing Knowledge, Innovation, and Leadership (SKIL) Act, addresses this growing problem by increasing the allotment of H-1B visas, returning to the prior, higher level of 115,000, with potential for future increases. The bill would also allow foreign nationals who graduate from U.S. universities to stay in America and contribute to our economy by joining the American workforce.
“Unfortunately, we are not graduating the number of Americans with advanced degrees in math and sciences that our high tech and medical industries need to compete. Until we can fix the problem of not having enough highly skilled American graduates, we need to pass the SKIL Bill.”
Shadegg went on to say, “We stand to potentially lose the next technological giants like Yahoo! or Google if we do not keep America’s workforce competitive. We must maintain our edge by providing opportunities to highly educated and skilled individuals interested in staying here in the U.S.”

Not entirely correct. When as you say this country treats all Employment based immigrants equally, why set quotas, why distinguish between EB1, EB2 EB3 etc.
The point is there are rules and they tend to favor certain applicants over others in the queue. More education generally does mean more skill. It does not always mean more pay, but this country has decided to use education and work experience as the criterion for EB category allocation.
How can you say all nations have an equal opportunity to immigrate to the USA. That is patently false and you know it. Now you can defend it and say it is the US right to set its rules the way it wishes, and I can respect that, but to say it is equal opportunity is wrong.
What I have said all along is that EB immigration is to redound to the benefit of US EMPLOYERS not you or me. That is why the rules were skewed so much in their favor. Now, we agree there has been some abuse in this system, by those this system was meant to help, however its purpose remains intact. The rest of the rules are secondary to this intent, but nevertheless important.
The USCIS/DOS set quotas for visa numbers because the United States does not want to be overwhelmed with immigrants. And these quotas are spread evenly through all nations and ethnic backgrounds. Considering the populations of the "oversubscribed" nations, this is justified. I can see where the immigrants from these nations feel "discriminated against" in the fact that they receive a smaller percentage (NOT NUMBER) of visas per capita than ROW countries. This does not make the system unfair. And if you think that certain countries get special treatment, think again; there are plenty of people in ROW (like me) who have been waiting for years as well!

I sent my EAD paper file on 29th May to TSC. I received my EAD's today for 1 year. Cutoff date for 2 year is 30th june.

logically speaking, it should be good for us. Had it not been for the conservative house republicans and speaker hastert, CIR along with its many favorable provisions for us could have been law by now. So with that obstacle out of the way, things should be better for us.However, politics is never logical and immigration reform is neither the top priority nor a done deal with the dems. From our perspective, we got to raise awareness about our cause all over again since most of the new congressmen will be unaware about problems afflicting skilled legal immigration.
Looking at few early Election results, it seems that Dems are winning. Needs to check how they will be do good for us. Any thoughts?

The answer to your question is that paper-based EAD got approved in 15 days also. We have so many postings and thread indicating average time to 25-30 days. But still on USCIS web site it is 90 days.
This processing is depending on service center. I think TSC is doing very fast, to the extent that many IV members are blaiming that USCIS is milking us - If they give before Jun 30 it is just for one year. Had they been not doing so fast, it would have been two years EAD.
If you get after Jun 30 you are lucky in terms of getting EAD for two years.

So assuming this is all correct and comes to pass what will EB GC applicants do from the date this is decreed to take effect (May 15th, June 19th October 1st etc.) until October 2008? Will there just be no applications allowed for over a year and existing applications made past the cut-off date get scrapped?

To add to this.. Some will think that something good just going to happen since next year is election.. Not sure what makes them think that..
Some are extremely negative-- They will say doesn't matter what you guys do,nothing will happen.
Those with negative opinions - they do not do much in life too - most of these wake up late in morning, go to work, watch TV , lazy in weekends , play cards, chat on phone , always spend a lot of hours on the internet researching for some crappy deals on electronic goods - the time, if well spent is worth more than what they save on buying the item.
Though it is difficult to change their attitude - it is possible, we must be persistent in our effort.

We've received information that Congressman John Shadegg of Arizona's 3rd District (http://johnshadegg.house.gov/) has introduced SKIL bill in the house and it has 10 Republican Co-Sponsors.

We hope to see this bill pass the House. It may have to jump a few hoops though. In order to bypass the House Judiciary committee it has to be introduced on the house floor and House Republican Leadership can do that. Its a strong possibility given the 10 co-sponsors.
However, it seems that some legislators are realizing that the reform in legal immigration to reduce backlogs is neccesary and overdue and would have to precede CIR if CIR is going to be stalled.
We will update this thread with more information when we know more.

2. He is not going to do anything for anyone in his last few months. Especially for us who are not in anybody's radar.
3. The white house is better staffed to handle mail and has a larger team to scrutinize mails. Truth is Bush meay never hear about 25K mails sent over a month.

This is a good effort but wrong target. May be ppl sense that and are holding off.
4. We cannot be just an internet forum anymore we need meet n greets..periodic meetings that bring ppl together face to face.

If you disagree with IV's goal that is fine too but it is unfair to hundred of volunteers who are as smart and analytical, as yourself, if not more and still spend hundreds of volunteer hours on this campaign and come back to be greeted by such unhelpful and critical posts.
The reason we might fail will not be because of high odds against us, or wrong target, rather inaction and refusal to either be a leader or a follower on IV campaign issues

Majority of these sponsoring congressmen have a green (anti-immigration) rating, some of them having a green-red (mixed) rating. However, they're mostly red (pro-immigration) when it comes to h1-b or related skilled worker bills (this even includes sensenbrenner's votes!)..
I did all this search out of boredom, but more importantly to assuage my sinking heart. So it looks like with the sponsorship of 10 pro-skilled immigration republicans, and at least not-against-skilled immigration republican leadership, this represents a good sample of republican votes for the passage.
Question remains how and when this bill will make it to the congressional agenda now that the summer is here already.
I keep my fingers crossed.

I am also worried. I called my attorneys office to inform them but of course like always he is in a meeting. I am sure this was an error but I am hoping its not call me optimistic but I like the smell of green card :)
Hopefully, as others suggested, it is a case where they took your 2004 RIR labor date and approved your current petition when that date was current.
Either way, wish you the very best.
