    My responses are below:

    My question:
    1) Shall I disclose the arrest to the attorney ? I am concern that it may backfire as I said "NO" for arrest in the background check forms etc.

    You Should say "YES" and produce all the court records.

    2) Can I travel & enter US without any issues ? Do I need to carry the expungement letter with me all times entering US?

    I would advise not to travel unless you get an attorney to review all your documents and get a confirmation that you are not subjected to any bar under Sec 212 of the INA.

    3) Does my arrest go to FBI ? Will I be asked for interview when my PD becomes current ?

    You could called in for an interview. But there shouldn't be any problem once you have all the records.

    4) What should I beware ?

    Hi,

    I have a relative who is trying to obtain an F1 visa from Dubai where he works as a script writer. He is trying to go to the US to study broadcasting and get only an associate degree so it can help him in his career..so I have few questions:

    1- Will it be helpful and can he mention in his interview at the US embassy that he will be writing scripts to his company(which he gets paid for) while being in the US?

    2- Does he need an f1 visa if he tries to apply to a vocational school? or does he need another type of visa for the vocational school?

    Hi,
    I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.

    As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).

    Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

    Yes.

    ... should my H1b remain valid till her COS to F-1 is approved? ...
    Yes. The moment you lose your H1-B status, she loses her H4 status.

    My wife's labor has been stuck for 2 years ( she got an RFE ). Her company lawyers arent too helpful and asked us to just wait. Wanted to know, what steps one can take to try to figure out what is happening.

    I just had a consultation this week with an engineer working on an H-1B for several years with one of America's best known companies.     Your passport has nothing to do with you invoking AC21. AC21 is just a way of informing Uscis that you are switching to another job with similar duties, that's all. There's no official form or application to submit.

    Just apply for the renewal of your passport as you would usually do. That's all.

    I was wondering if anyone has an idea of why some folks get FP before getting an EAD, and some get their EAD's without a FP? Any logic to that?

    Really disappointing. Senator Schumer says on the one hand that the targeted companies are not violating the law and on the other says they are underpaying their workers - which would be a violation of the law. Which is it? And he disparages the entire staffing industry - an industry that in the US employs far more American citizens than immigrants - by questioning the legitimacy of the business model and complaining that these companies don't make anything.     Hi All,

    I need some advise on my situation.

    I am working in India and my H1B visa has been approved to work with a client in the NJ area. After the visa approval and before the stamping, my employer has asked me to go and work with a different client in the NY area (as my original client project got canceled). So, the client and the location are changing.

    So, I will be going for my H1B visa stamping with a client letter and location different from what is in the petition. Is that OK or is it a sure shot denial case?

    Do I need a new LCA or H1B amendment? My employer is not keen on doing them, and thinks that it should not be risky to go with the existing paper work.

    Please give me some advise.

    its mostly additional security review. A friend of mine was in similar situation, took about 6-8 weeks for him to get a visa.... but unfortunately client wasn't ready to wait that longer.....
