I140 is pending, Filed EB2 485 on Jul2nd, no receipt yet, and we don't know when it will come.
My wife's F1 is going to expire on Aug28. I was planning to file COS to H4 for her now. However, today I heard that filing AOS and COS at the same time will be a conflict and one case might get denied.
Should I still go ahead and file her COS now or wait some more time till we get the 485 receipt? The concern I have is that AOS is not a safe status since 140 is still pending now. However we don't want to mess up 485 just because of the COS application.
Can anyone give me some suggestion on this situation? Hope this is the right place to post the question.

If you're already eligible to use AC21, then I see no problem working as consultant as long as it is of the same job category as your LC. ATP and location does not matter anymore.

Encouraging. Darryl Issa, the powerful new GOP House Oversight Committee Chair, has introduced this bill in the past, but with the change in party control, he's got a lot more clout this time around. Last year, employers submitted so many H-1B petitions, the USCIS had to pick the winners by lottery. This year, seven months after the opening of the filing season that started on April 1st, the H-1B cap has yet to be reached. However, the numbers may not last long. I recently received my FP appointment date, but I have to be on a conference the previous day. If everything goes well, I can arrive to my appointment without any problem.
But if my flight is delayed or cancelled I might risk being late to the appointment. My appointment is 10:00 am in the morning, are they very strict about the timing for FP appointment, or can we go a little late if we were delayed? Can you please share your experience?
Also, How early should we call in to postpone the appointment?

Does anyone understand what they mean by "Applicants entitled to immigrant status become documentarily qualified at their own initiative and convenience."
Does it mean that ppl file I485 at their own initiative (but thats not true since we cant file it until numbers are available), or does it mean that we should call USCIS and pester them and ask them "Is my application documentarily qualified ?"
Is that the same state as "preadjudicated" ?
Isnt it weird that AOS is the last group of people who get assigned numbers ? "CIS requests visa allotments for adjustment of status cases only when all other case processing has been completed."

Wow! This act was so good. And I see 27 sponsors! What ever happened to it??? Maybe we should petition to get this introduced again, this was more like a real reform. It seems like Democrats supported it, but probably lost the fight with Republican congress at the time.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.

hi,
I am unmarried son of citizens of usa and have my priority date current.I filed for I485 adjustment of status to permanent resident, which earlier got rejected,but then on refiling,I got a MSC receipt number saying next process is biometrics
My question is that as I am presently on student visa and my classes are starting from august 17th.Do I still need to maintain my student visa status and enroll in 12 minimum units,or is it ok If I don't enroll and just wait for my further case processing,and I won't be considered out of status as my I-485 adjustment of status is being processed?Is there still chance of my I-485 being denied(I don't have any criminal or any wrong record and maintained my status prior to filing my I-485 adjustment of status).Please guide whether to still enroll in 12 units and be on student visa or is it ok if I don't enroll as I no more want to pay high fees but,am worried about maintaining my status.

Hi,
I am filing the PERM application in EB2 Category. The position needs Bachelors + 5 Years (or) Masters + 1 year. I do have 30 months expereince after finishing my Bachelors degree and 11 months expereince after finishing my Masters degree.
Will I be eligible to file in EB2 as I have Masters degree and more than 12 months of expereince after Bachelors.
My questions is -- How do you count the expereince if its Masters + One year
Will you count one year after finishing the Master Degree completed (or)
Will you count one year after finishing the Bachelors Degree.
