With I 485 pending you need an EAD to be able to apply for a social security number. I believe it is not uncommon for parents to apply for employment authorization for a minor to do just what you are asking.

Talk to an attorney he should be able to kiss your employer's ass with lot of things.
If your employer is paying more than what is mentioned in H1B, then you cannot do anything.
If you are working on % basis, then forget about 14k if till you work for him, prorate of H1B pay is paid.

Can someone clarify my issue.
I applied for H1-b in 2008(I was in L1 when i applied).My employer never gave me my recipt number and i didnt even knw the status for a while ( though he said he applied without COS).Later he told it was applied with COS.
Later after numberous calls and mail he gave me a recipt number ,but the
status on USCIS website was "Notice Undelivered as of June 2008".
I could never find ,whether it was RFE or Approved status.I called up USCIS they said employer has to call to confirm the status.My employer said he will follow up with USCIS but he never did and he is absconding now .I cant reach him ,no phone,no mails.So i continued on L1.
Since my extension is coming up.I wanted to make sure my status hasnt changed because of this issue.
Has anyone faced this situation? Had that notice (undelivered) been an approval letter ,would that change my status though it was never accepted (Its undelivered as of Jun 2008)

Hi ,
I Am planning to apply for my 10th Year H-1B Extension with the same employer.
My last H-1B was in 2007. I looked on doleta.gov The Prevailing Wage
in 2007 for the same job and same location as I am right now at
Level 3 was 57000.00, Now in 2010 it is 76000.
I talked to my Employer about this, he says he cannot raise my salary that much.
My Question is
1. When I applied for Foreign Labor Cert On-line does the
Prevailing Wage has to be most recent even in case of H-1B Extension ?
2. Is is ok If I go to Level-2 Instead of Level-3, will it considered as
change in Employment ?
3. The Prevailing Wage for 2008 for the same job and same location
as I am right now at is 66000. Should I Try to Apply for labor
cert referencing 2008 Prevailing Wage. ?
4. What are my options ?

I am trying to put together documents for my wife's 485 application. The birth certificate was re-issued a couple of years back (with corrections to her mother's name and including her last name which was missing earlier).
The lawyer says we need to put a good reason down for 'why a corrected birth certificate was not obtained until now'.
Do you guys know of a good reason to provide USCIS? Know of any reason which was accepted in case of your friends?
Please do advise. Thanks!

I have applied for I-140 thro Substitute in March 2006(15 months ago) and I got a query on my education and company financial status in August 06 and attorney replied back to query in the month of October 2006.
When I check my status online shows as "we received your application on October 20th 2006 and in process".
Last month there was an updated date on 05/25/07 on my case and when i checked with employer, he says we have not yet received any information from USCIS to attorney.
Now the attorney says, we will be Re-filing my case, as one case got denial from my company (Not mine itseems). So that we will get new Receipt Number as I have only 8 Months left on my H1 and we can apply for 1 year extension meanwhile before 6 months of H1 expiry.
Is it a good idea to re-file I-140 from the same Service Center(NSC)?
or Can I apply in PERM now as I have only 8 months on my H1.
Pl. suggest.

Those who are subject to the additional fees include petitioners who employ 50 or more U.S. employees and more than 50 percent of its U.S. employees are in H-1B or L status (including L-1A, L-1B and L-2). For example, ABC company has 60 employees and has 35 employees in H-1B and L-1 status. ABC Company would be required to pay the additional fee for all new H-1B and L-1 petition filings. Extension of status petitions are not subject to the additional fee. The new fees are effective immediately, applying to all petitions submitted on or after Aug. 14, 2010 through Sept. 20, 2014.

Can you get AP when you are out of status anytime during your stay in USA, if you get AP can you travel outside USA and enter back using it.

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP
