If one has Green Card based on family preference (son of US citizen), how long he has to stay in USA to maintain his Green Card. I heard it is min 180 days in a year ? Is that correct ?
What are other restrictions ? Does it impact citizeship ?
A detailed answer would be very helpful.
Also If one has Green Card which one if faster router to get his spouse to USA:
1. Applying as daughter in law of US Citizens. Or

2. Applying as wife of person having Green Card

It is a one way street once that check is cashed. No refunds from USCIS. If the application gets returned from the mailroom for some mistake like missing signature, you will get your check submitted back.

My story:
In my 2 work exp.letters submitted to CIS, I break down the number of months I was working with company A with 2 different positions and stated my duties & responsibilities. I started as an electrical technician from 06/'07 - 01/'98 (7mos.) and move to Sales Engineer position from 02/'98 - 09/'98 (7mos.) so that a total of 14 mos. CIS only counted the electrical technician experience since my labor application position is electrical technician. However, the position of sales engineer, also entails the work of an electrical technician. meaning sales works is an added duties for the technicain job.
Moreover, my second letter, company B with a job title of Technical Trainee was totally disregarded. Where in fact, my work is actualy training a would be
"electrical technician". Now I just need to find ways to justify that to CIS. I dont know how to start though...could anybody help me here????

Say, there seems to be some confusion over the which is the SKIL bill and which is the Comprehensive Immigration Reform Act (CIRA).
GovTrack lists the Comprehensive Immigration Reform Act as S.2611, sponsored by Sen. Arlen Spector. This was the bill that the Senate passed on 05/25/06. OK easy enough.
If I do a search for securing knowledge innovation in GovTack, S.2691 pops up, sponsor Sen. John Cornyn. OK all good.

I'm currently on H1B with a pending employment based I485 (EB3 category). I married my wife (USC) a year and an half ago and we decided to file a family based I1485 petition. We are currently preparing the forms and we have a few questions.
1. I485: Application Type Question: In my employment based I485, the option a. was selected for Application Type (An immigrant petition giving me an immediately available immigrant visa number that has been approved). What should we choose for this family based petition.
2. I765: (a) Applying For: When the company applied for employment based 485 few years ago, I got my EAD. I never used EAD as I always had my H1B. Hence, should I select "Permission to accept employment" or "Renewal of my permission to accept employment (attach previous employment authorization)"?
(b) Question 16: Eligibility under 8 CFR 274a.12 ( ) ( ) ( ). For my employment based application, it was (C) (9) ( ). What should it be for my family based application now?

Hi Guys,
All my checks got cashed on friday....today my lawyer office got a notice saying that there is no FP fee eventhough they cashed it.
they asked to resubmit the fees again...my lawyer said he will work it out with them..
My questions is I filed to NSC, transfered to VSc and today they status says it has been transfered to TSC :confused:
So should i submit this evidence to VSC or TSC.
Please clarify.

I want to know whether I can legally open some business in USA. A sole proprietorship is the simplest business format in USA. I am currently in F1(OPT) visa and will be H1B visa sometime later. Whether F1(OPT) and H1B visa holder can legally open sole proprietorship in USA?
My attorney told the foreigner without Green Card can open business in USA but can't get paid. The sole proprietorship count all business profit/loss as individual income/loss for tax. (Form 1040 Sch C) I am afraid this is not legal for my current visa status.
Anyone here has opened business in USA without a Green Card legally? If yes, could you please share with us which type of company you opened? (Inc, LLP, or ...?)

I have concurrent filed I140 and 485 in Aug 2007. My I 140 is still pending. Can some one let me know what could be the reason. Is there any one whose i140 is pending since last three years.I am worried because processing time is around 4-6 months.Any help in this regard will be appriciated.

If you resigned, then I dont think company is liable for any severance. I work for a bank and they have a policy that they consider attrition due to visa issues (like unable to extend H1 etc) as termination for employment. They pay severance only for displacements which happens due to lay offs. I may be wrong and policy might be different in your company but just my 2 cents.
